Terms and Conditions of Use
These Terms and Conditions govern your access to and use of the International
Women's Media Foundation ("IWMF") web site (the "Site").
BY USING THIS SITE, YOU AGREE TO THE PROVISIONS OF THESE TERMS AND CONDITIONS
JUST AS IF YOU HAD SIGNED THIS DOCUMENT. If you do not wish to be bound
by these Terms and Conditions, please exit the Site immediately.
Information Posted by IWMF.
Copyrights and Other Intellectual Property. Except as expressly
stated in this Website, all information, documentation and other content
posted by IWMF on the Site (collectively, the "Information")
is the property of the International Women's Media Foundation (IWMF).
"Information," for these purposes, includes the graphics,
icons, organization, arrangement, and overall appearance of the Site,
all of which are also the property of the IWMF. Our posting of these
materials does not constitute a waiver of any of the IWMF's proprietary
rights in such Information (such as, but not limited to, copyrights
or trademarks) or a transfer of any such rights to any third party.
The Information is protected by U.S. and international copyright,
trademark, and other laws and conventions, both as individual works
and as a collective work and/or compilation. Except as IWMF expressly
consents in writing, you may not sell, reprint, or republish the Information
for any purpose, or copy the Information other than for your own personal
non-commercial use. Without limiting the foregoing, you agree to abide
by any and all additional copyright notices, information, or restrictions
contained in any Information on the Site. You further agree not to delete
any copyright or similar notice from any Information obtained from this
Website.
Materials Obtained from Third Parties. In addition, many of
the materials within this site, or linked to this site, are copyrighted
by various organizations and are subject to their copyright terms. Some
photos have been provided for the site by individual photographers and
may not be used without explicit permission from the photographers.
Individual photographer credits can be found by clicking on individual
photographs.
Information Posted by Users.
Right to Use. By posting text, graphics or other materials on
the Site, you automatically authorize other users of the Site to download
the materials for their own personal, noncommercial use. You also authorize
IWMF to reproduce and use the materials in whole or part in any portion
of the Site or in its printed and other published materials without
notice or compensation to you. IWMF may, but will not be obligated,
to credit you as the source of the material you provide.
Your Obligations. In posting materials on the Site, you agree
that you will not post or transmit materials that: (i) are unlawful,
threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic,
profane or indecent information of any kind, including without limitation
any transmissions constituting or encouraging conduct that would constitute
a criminal offense, give rise to civil liability or otherwise violate
any local, state, national or international law; (ii) contain harassing
or offensive language, including sexual references, sexual nicknames,
racial slurs or rude or deliberately offensive comments or make excessive
use of scripts, sound waves, scrolling (repeating the same message over
and over) or other disruptive materials, or use viruses, bots, worms
or trojan horses; (iii) violate or infringe the rights of others, including
material that represents an invasion of privacy or publicity rights
or which is protected by copyright, trademark or other proprietary right,
or derivative works with respect thereto, without first obtaining permission
from the owner or right holder; (iv) encourage or provide instructional
activities about illegal activities, in particular hacking, cracking
or phreaking; (v) are intended for commercial purposes or that contain
advertising; (vi) solicit other users to join, become members of, or
contribute money to any online service or other organization, advocate
or attempt to get Users to join in legal or illegal schemes or plan
or participate in scams involving other users. In addition, you agree
that you will not (A) impersonate any person or entity or falsely state
or otherwise misrepresent your professional or other affiliation with
any person or entity; (B) resell, redistribute, broadcast or transfer
the information or use the information in a searchable, machine-readable
database; or (C) use the Site to collect personally identifying information
about Users of the Site in violation of our Privacy Policy.
Monitoring. You understand that IWMF has no obligation to monitor
the materials posted by users. However, IWMF reserves the right at all
times to refuse to post or to remove any information or materials, in
whole or in part, that in IWMF's sole and absolute discretion are objectionable
or in violation of these Terms and Conditions. You acknowledge that
IWMF reserves the right to, and may from time to time, monitor any and
all information transmitted or received through the Site for operational
and other purposes. During monitoring, information may be examined,
recorded, copied, and used for authorized purposes in accordance with
our Privacy Policy. Use of the Site constitutes consent to such monitoring.
Infringement Policy.
IWMF has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Digital Millennium Copyright Act. Our designated agent to receive notification of claimed infringement is:

To be effective under the Act, the notice must be in writing and must include the following information:
A. A physical or electronic signature of a person authorized to act on behalf of (1) the owner of an exclusive right that is allegedly infringed or (2) the person defamed.
B. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. Similarly for other types of infringing materials, a list of such materials.
C. Identification of the material that is claimed to be infringing, to be the subject of infringing activity, or that is claimed to be defamatory and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
D. Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and/or electronic mail address.
E. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright or other proprietary right owner, its agent, or the law.
F. A statement that the information in the notification is accurate,
and under penalty of perjury, that you are authorized to act on behalf
of the owner of an exclusive right that is allegedly infringed or on
behalf of the person defamed.
Third Party Sites.
IWMF.org welcomes the opportunity to share resources and facilitate
links to and from websites whose content complements, enhances, and/or
provides relevant information on the issues central to this site. Each
request will be evaluated individually based on these criteria. To provide

General.
Modification. IWMF reserves the right to amend these Terms and
Conditions, and to modify, add or discontinue any aspect, content, or
feature of the Site. Such amendments, modifications, additions or deletions
shall become effective upon notice thereof, which may be provided to
you by posting on the Site. Your continued use of the Site indicates
your acceptance of any such amendments, modifications, additions or
deletions.
Miscellaneous. These Terms and Conditions shall be governed by and construed in accordance with the laws of the District of Columbia without giving effect to any principles of conflicts of law. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. These Terms and Conditions and any posted operating rules constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default. The titles and subtitles used in these Terms and Conditions are used for convenience only and are not to be considered in construing or interpreting these Terms and Conditions.
